Uhuru, Muthaura Want ICC Trial Delayed

Deputy Prime Minister Uhuru Kenyatta and former Head of Public Service Francis Muthaura have petitioned the International Criminal Court (ICC) to delay the start of their trial.

Kenyatta and Muthaura defense teams asked Trial Chamber V judges to postpone commencement of their trial from 11th April to a new date due to the introduction of new evidence by the prosecution.

Uhuru's lead Counsel Stevens Kay and Karim Khan representing Muthaura asked for more time to investigate 28 new witnesses introduced recently.

They accused the prosecution of changing the nature of the cases facing their clients. They argued that the cases before the trial court are different from the ones confirmation last year.

Uhuru's lawyers further argued that they needed sufficient time to prepare following the prosecution's decision to abandon a key witness. However, the victim's counsel opposed the delay of the trial saying his clients were impatient.

Meanwhile, Jubilee Coalition running mate Wiliam Ruto and former journalist Joshua Sang also want their trial pushed forward   by four months from the date of disclosure to allow them more time for preparations.

The two through their lawyers told the trial chamber V Thursday that there are new witness, allegations and prejudicial materials that they time to go through.

Ruto's lawyer David Hooper and Sang's lawyer katwa Kigen challenged the prosecutor to provide them with all audio recordings or transcripts from the witnesses.

Hooper told the court that he prefers the case against his client to be heard in Arusha and not The Hague.

The two lawyers also suggested that the trail chambers V be constituted into two separate chambers for the trail of the two.

However, the three bench Judges said that it's not possible to conduct the two cases concurrently.
