Kenya Parliament Degazettes SRC’s MPs Pay Reduction Notice

A Kenya National Assembly Committe has todaydeclared unconstitutional, null and void the gazettenotice by the Salaries and Numerations Commission (SRC) that reduced their salaries.

The Committee on Delegated Legislation said thegazette, issued by the SRC on March 1st, two days before the elections and after the 10th Parliament had been dissolved. The MPs termed gazette as unlawful as it did not get the required parliament approval. “The gazette notice numbers2885,2886,2887 and 2888 dated February 28, 2013 and published by the Salaries and Remuneration Commission in the Kenya Gazette of March 1 2013 isunconstitutional, unlawful, ultra vires and therefore null and void,” says the committee.

The SRC in the March 1st gazette reduced the MPs basic salary to 542,000 down from 841,000 and the MPs in the 11th Parliament have been fighting the SRC to have the salary reduction rescinded since they took office and have threatened to disband the SRC.
