A man who assaulted his wife inflicting body injuries to her after she denied him séx will serve a year in jail or pay a fine.
Peter Muiruri is accused of committing the offence on October 9, 2009, at Bahati estate in Nakuru
The court heard that the accused on that day came home drunk and demanded for his conjugal rights. The wife is said to have denied him complaining that she had a headache.
Angered by her answer, he took a piece of wood and hit her on the head injuring her forehead.
She reported the matter to the police who arrested the suspect.
Appearing before senior resident magistrate Gerald Mutiso, the accused said that his wife constantly denied him séx without valid reasons.
While giving his ruling, Gerald said that provisions found in the law on rapé and attempted rapé do not exempt married couples. He was charged with attempted rapé and sentenced to a year in prison.
