The controversial pastor had earlier filed an application to stop his prosecution before court, Justice Korir certifies case urgent, to be heard tomorrow.
Director of Public Prosecutions Keriako Tobiko said Sunday there was evidence that he believes could sustain a conviction. Mr Tobiko added the Witness Protection Agency (WPA) had been roped into the case to ensure safety of witnesses. He said more witnesses had recorded statements with police officers and prosecutors handling the case.
The team handling the file is expected to hand it in tomorrow for Tobiko's final word on prosecuting the pastor. The file on Ng'ang'a was taken to the DPP last Monday but after some gaps were identified, he formed a team compromising police, prosecutors and officers from the WPA. They have since interrogated six more witnesses and filled the gaps ahead of the handing over of the file, officials said.
Police heard from witnesses that the pastor was the one driving the Range Rover and he was seen getting out of the vehicle after the accident at about 5pm on July 26 at Manguo in Limuru. Ms Mercy Njeri, 38, died in the accident while her husband Martin Mbugua Ndung'u survived with injuries.
