High court judge David Majanja directed the evidence be filed in court within 14 days.
“This case needs to be fast tracked. All the evidence required must be filed and served to the relevant parties as soon as possible,” Justice Majanja directed.
The judge was informed by lawyer Evans Ondieki for the 856 fire victims that “all documentation is ready it is only awaiting signature by the former Makadara lawmaker.”
The lawyer told the court that he has not been able to reach the senator as he has changed the telephone numbers he was using before the last general elections.
“My court process servers have not been able to find Mr Mbuvi in his Buruburu residence. They were told he has since moved to Runda Estate,” Mr Ondieki told the judge.
Said he: “ I am finding difficulties in reaching the senator but I hope to find him to append his signature on the documents.”
The judge was urged to indulge the lawyer for 14 days.
Justice Majanja directed the lawyer to serve all the parties in the suit.
Mr Mbuvi filed the case last year seeking compensation for the 103 people who perished in the morning inferno from the spillage of highly inflammatory discharge from the Kenya Pipeline Company (KPC).
In the pleadings Mr Mbuvi has categorised in three levels. He has identified those who died as 103 and will be asking the court to award them differently.
He is also asking the court to compensate over 300 people who suffered injuries and the rest are those who suffered loss when their businesses were licked by tongues of fire.
The rolling fire which was sparked by a spillage at the KPC environs in the morning of September 2011 left a trail of damage and loss of innocent lives.
Mr Mbuvi has named KPC and other government departments as respondents.
Justice Majanja fixed the case for hearing April 26,2013.
