There was a temporary sigh of relief for former Garsen Member of Parliament (MP) Mr. Danson Mungatana after a Mombasa judge disqualified himself from the case involving him in which he is accused by Equatorial Commercial Bank of issuing bad cheques.
Citing his reasons for withdrawal, Justice Richard Mwongo, felt uncomfortable handling a case in which the Equatorial Commercial Bank is a party since he is a former employee of the bank and as such his judgment might be compromised.
In the suit, the bank says it granted Mungatana with an overdraft facility with the view that he replaces the amount overdrawn withing a specified period. According to the bank’s legal officer Mr. Asin Brian, Mungatana paid the amount with four cheques of Ksh 500,000, 250,000, 950,000 and 500,000 which were fake. This caused the accountant to overdraw resulting to an outstanding balance of Ksh 6,031,597 by July 27th 2011. The amount continues to accrue an interest at the rate of 31% annually until full payment.
