Mr Brian Rotiken, a brother-in-law of the activist, said the bodies of Mr Mpoe and Mr Parsaaiya ole Kitu were still belted on the car seats when he arrived at the scene of the killing.
Mr Rotiken said Mr Mpoe’s body was upright on the driver’s seat while that of his colleague was in a stooped position.
The witness was testifying in a murder case against Ms Eddah Wanjiru, the widow of former Cabinet minister Mbiyu Koinange, her stepson David Njuno and five others.
Mr Mpoe and Mr Kitu were killed on the evening of December 3, 2010, at Soilo Junction as they drove towards Nakuru town.
The other accused are Mr Sanaga Mbukoi, Mr Nicholas Ngetich, Mr Johnstone Sigei, Mr Stephen Mwanga and Mr Kiragu Macharia.
Mr Rotiken told Lady Justice Hellen Omondi, sitting in Nakuru, that he was informed about the incident by his nephew by phone and rushed to the scene.
“There were many police officers and journalists at the scene. The bodies were later removed to a mortuary but I went to the Rift Valley Provincial General Hospital to check on another relative who had survived the attack,” he said.
Shot several times
Mr Rotiken told the court that a third person, Mr Joseph ole Mpoe, who was on the back seat of the vehicle, was shot several times and taken to the provincial general hospital.
Asked by the defence lawyer, Mr Gordon Ogola, if the survivor was conscious by the time he saw him at the hospital, Mr Rotiken said he could not tell because he did not talk to him.
“I found the survivor lying on a bed with his face covered in a white towel and I cannot tell if he was conscious because I did not talk to him,” he added. -Daily Nation
