He is required to report to Kayole police station immediately to have his finger prints taken.
The Director of Public Prosecution had applied for the MP to be detained in police custody for 48 hours to facilitate completion of investigations which include Waititu recording a statement and having his fingerprints taken.
During his release, the judge said that the DPP did not justify Waititu’s detention.
The prosecution side has however been allowed to bring in more charges against the MP including murder.
Waititu was charged on Thursday with incitement to violence and hate speech in connection to utterances he made against the Maasai community in Nairobi’s Kayole Estate.
