Royal Media Services might Shut Down After Court Ruling

Royal Media Services is at risk of losing its frequencies after the Court of Appeal declined to extend orders blocking the Government from confiscating them. And while denying RMS their application, the appellate judges explained that the Communications Commission of Kenya (CCK) would return frequencies, if the appeal they lodge were successful.

Judges GBM Kariuki, Philomena Mwilu and Jamila Mohammed said the applicant failed to demonstrate the appeal was arguable.

“From the circumstances of the application before us, the applicant has demonstrated that the appeal is arguable but has failed to demonstrate that the appeal will be rendered nugatory if the instant application is dismissed,” they said.

RMS had moved to court arguing that its entire business of broadcasting and its investment worth about Sh1.4 billion and a wage bill of approximately Sh180 million, had been affected by the CCK move.

Early this year, Justice David Majanja dismissed a suit filed by the media house against CCK after the regulator seized 17 frequencies, which were allegedly acquired illegally.

Majanja had in his judgment however, granted the company a 30-day reprieve, to allow it move to the Court of Appeal.
