Two foreign men, an Italian and a Polish, have taken a Kenyan woman to court alleging she separately obtained money fraudulently from each of them after alleging she was pregnant.
Lynnder Achieng Ondago appeared at the Kibera Law Courts on March 20 charged with three counts of obtaining money through false pretences.
Dressed in a brown jacket, white top and black trousers, Lynnder pleaded not guilty to the charges, in a case whose spaghetti bowl details are expected to be revealed in court in the coming weeks.
Court documents and police records seen by The Nairobian allege that Lynnder deceived each of the men that she was carrying their child. She is later alleged to have informed each of the men that she had miscarried.
Documents obtained from her court file number 937/013 indicate that Lynnder is accused of contravening section 313 of the penal code on three charges.
The file reads that Lynnder was arrested on March 17, 2013 by two criminal investigations department officers in Mombasa and was brought to Nairobi before being arraigned in court.
The first charge states that between June 6 and June 21, 2012, she obtained money from Polish national Tomasz Boguslaw under false pretences.
The charge further states that she lied to the complainant that she was pregnant, and later miscarried, prompting the complainant to send her money for hospital bills to the tune of Sh90,000.
She also faces a second count of obtaining money by false pretences again from Tomasz Boguslaw. “Between 13th December 2012 and 31st December, she obtained through false pretense Sh60,000 from Tomasz Boguslaw by pretending she was pregnant by him, and had suffered a miscarriage.”
The Kenyan woman is also charged that between December 22, 2012 and January 4, 2013 she allegedly obtained Sh110,000 from Italian Armeno Cosimo Modugno by lying that she was pregnant and that she had miscarried.
According to police statements in her file, Armeno claims last year he travelled back to Italy for Christmas holidays and on December 20 Lynnder called him and said she was heavily bleeding.
“I immediately told her to go for medical attention at Aga Khan Hospital Mombasa. But she insisted that she wanted to go to a local clinic.
I was perturbed because as a fatherto- be, I wanted my girlfriend to get the best medical attention,” alleges Armeno in his statement.
Additional Sh85,000 He further claims he called his business partner in Nairobi, a Mr Owiti and asked him to help his girlfriend go to a good hospital. Owiti supposedly tried taking to Lynnder but she was reluctant to go to a good hospital saying it was very far.
According to court documents, Lynnder later on the same day is alleged to have called Amerno to say she had lost the baby.
“She didn’t even prompt me but I immediately sent Sh25,000 via Western Union. The next day I sent an additional Sh85,000. I was in love,” alleges Armeno in his statement. He claims he cut his holiday short and flew back to his house in Nairobi to nurse Lynnder back to health. He alleges that he went to his house and found that Lynnder had already left, and had taken away laptops, iPads, and other electrical appliances and Sh250,000 in cash.
Armeno then reported the matter to the police, leading to Lynnder’s arrest. After being arrested on February 6, it is claimed that a German, who is alleged to be Lynnder’s boyfriend, came to the picture and immediately posted bail. The theft case will be heard on April 14.
The other man, Polish businessman Boguslaw Tomasz Ficek, claims he met Lynnder through a dating website.
“I came to Nairobi for the first time last year and she was waiting for me at the airport. We proceeded to Mombasa where we rented a house in Mtwapa.
After a month of having a good time, I flew back to Poland and she CapitalNews told me she was pregnant… I couldn’t deny responsibility and in fact I started supporting her financially. I paid her rent and everything she needed and even supported a son she had gotten from a previous relationship,” he alleges.
When the two men talked Tomasz claims that when Lynnder told him about the miscarriage, he was heartbroken and immediately sent her Sh90,000 to ease her pain.
He has copies of Western Union documents of the payments he claims he has been making to Lynnder for almost six months.
“I came back to Kenya after two months to console her on the loss of the baby. I stayed for one week, and then left. A week after I had gotten to Poland she told me she was pregnant again.
I was so happy and told her not to work anymore but to relax so as not to miscarry again, I doubled my efforts and kept sending her money,” he alleges in his statement.
According to police statements, Tomasz alleges he sent her Sh60,000 to go for a pregnancy check at a good hospital and to ensure she takes great care to avoid another miscarriage.
“After sending her the money, she stopped replying my texts and picking my calls. I was so worried and I wanted to come to Kenyan and check if she is ok,” continues his statement, written in broken English.
“In the day of 4 February, I received one call from Mr Armeno Modugno where he start asked information about me and Lynnder and I told him that I was in relationship with her from May 2012 to January 2013 and then I discovered that Lynnder was one cheater and scammer because Armeno told me that in same time him was in relationship with her and she lived at home of him in Nairobi, and wa very bad all that Armeno told me was that she pretend to him to be pregnant from September 2012 and in 21 December she lost the baby for one ectopic pregnancy,” alleges the Polish man.
He further claims that after talking to Armeno he realised he had been deceived and the two of them decided to report to the police.
The third man in the saga, a German thought to be to be Lynnder’s boyfriend (name withheld), is said to have flown to Nairobi to sort out the matter.
“You people are just jealous of my girl. I will support her as much as I can, because she is currently pregnant with my child,” said the German when this writer reached him on the telephone.
Our sources indicate that he even offered to pay back all the monies spent on his supposed girlfriend and settle the matter out of court. But the other two other foreigners appear determined to see the legal process reach its logical conclusion.
In her statement, Lynnder says all charges brought against her are false. She claims that whatever she received from the two men were gifts. She was released on a Sh300,000 bail.
The hearing of the case is set for May 14.
