Former deputy Chief Justice Nancy Baraza and security guard Nancy Kerubo have asked Law Society of Kenya chairman Eric Mutua to mediate a complaint pending at the Director of Public Prosecutions’ office.
The LSK chair has written to Mr Keriako Tobiko saying that lawyers of the two have asked him to help seek an out of court settlement or else the DPP will prosecute Ms Baraza for allegedly harassing Ms Kerubo.
“I have been approached by advocates of the two parties to try and mediate. This is therefore to plead with your office to allow us time to reach a settlement, which will of course be subject to your discretion,” Mr Mutua says in the letter dated October 24.
State ready
This comes only days after Ms Kerubo’s, through her lawyer Thomas Maosa, wrote to Mr Tobiko asking him to put on hold prosecution against the former deputy CJ until the two parties finalise negotiations on an out of court settlement.
In the letter, Mr Maosa says that they would withdraw the complaint if the on-going negotiations succeed. Mr Tobiko confirmed receiving the letter, adding that it was a request to put on hold the prosecution and not a withdrawal.
He said his office was considering the request by Mr Maosa.
“We are ready to move on with the prosecution but we will consider the request,” Mr Tobiko told theSaturday Nation on phone.
